On a 1-2 pitch, R2 attempts to steal 3B as the batter attempts to check his swing. R2 is thrown out at 3B for the third out. The defense now wants to appeal the check-swing on the batter so that if he went around, he struck out and would not come back to bat in the next half-inning. U1 checks with the base umpire and U2 confirms that the batter did indeed swing at strike three. What's the ruling?</strong>&nbsp;<br /> <br /> <span style="color: #006699"><strong><span style="text-decoration: underline">ANSWER:<br /> </span> <br /> Jaksa/Roder has this to say on a similar play: <br /> <br /> "R1, two outs, 0-2 count on the batter. R1 is stealing when the batter checks his swing. The catcher throws and R1 is tagged out at second. On appeal the base umpire rules the partial swing a strike: such an appeal can occur. The batter becomes the third out, but such out is not an advantageous fourth out, it is simply an out that occurred before the tag at second. Note that the determiniation of which player is, in fact, the third out is important for the reason that it determines the proper batter for the next half-inning." <br /> <br /> So: yes, the batter is the third out because the actual 3rd strike happened before the tag.<br /> <br /> There may be other situations that require an advantageous 4th out appeal as in Rule 7.10, but this isn't one of them.
